Oregon BHO Explosion – Flash Fire – Product Liability – Confidential Settlement
In what is thought to be the first lawsuit of its kind—anywhere—Flynn Law Firm represented a burn survivor who was severely injured in a flash fire which occurred during the cannabis extraction process. Jonah pursued novel failure to warn and product liability theories against the manufacturer and retailer of butane which was designed and used for cannabis extraction. Despite the foreseeable use of butane for extraction (including marketing directed towards the cannabis industry), butane companies and retailers failed to warn or instruct about the dangers and hazards of unodorized butane when used in the extraction process, including that it is heavier than air and may travel great distances to reach a source of ignition. Shortly after the case was settled, the primary defendant was indicted by the U.S Attorney in the Southern District of California for illegally selling butane all over the United States. https://www.justice.gov/usao-sdca/pr/company-owner-admits-supplying-butane-make-illegal-hash-oil
