Atlanta Workers' Compensation Attorney

If you have been injured on the job, you are automatically entitled to Georgia workers compensation benefits. These benefits can include free medical care and weekly monetary help.

Workers compensation is an employer-financed, no-fault insurance, which aids employees who have been hurt due to work-related injuries or disease.

Georgia workers comp claims are different than personal injury cases. Georgia's workers comp law doesn't involve proving fault. The law says that if you are injured while at work, you are covered. And every employer in Georgia with more than three employees must provide this coverage. Jonah Flynn is an Atlanta workers' compensation lawyer representing injured workers who have been injured on the job. If you have been involved in a Georgia workplace accident, the Flynn Law Firm can pursue your claim and help you recover for your injuries.

Steps to take after you have been in a workplace accident.

If you are hurt at work, you should report it immediately to your supervisor. Write down the name of the person you talked with, as well as the date and time of the incident. This could become important later.

If you are seriously hurt, call 911 or go the emergency room. Make sure you specifically report to hospital personnel that this is a job-related injury. In most cases, your employer's workers compensation insurance will pay for emergency care.

If for some reason you hurt yourself and think you will get better, but you don't, you can still benefit from workers' comp. But you must notify your employer. Georgia law allows 30 days to give notice of injury, but the sooner you report it, the better.

If for some reason your employer doesn't cooperate with you - brushes you off, says you weren't hurt at work, or says you have a preexisting injury, you should call a Georgia workers' compensation attorney today.

The law gives an employer/insurer 21 days to investigate a claim initially, and then up to 81 days to investigate for new evidence. But you can receive help before then.

Under Georgia law, every employer with workers compensation insurance is required to have a list of physicians for you to select from. A valid panel must contain at least six unassociated medical care providers, one of which must be an orthopedist. If your employer doesn't provide this list or explain it, you may be able to pick your own medical provider.

Once your claim is accepted, you will receive a weekly payment equal to two-thirds of your average weekly wage, with a cap depending upon the date of your injury.

Injured workers often ask how much they can expect to be awarded in damages. Determining this isn't an easy answer. It will include how severe the injuries are and other economic factors such as length of medical treatment, loss of wages, and any permanent injuries.

The Flynn Law firm, and Atlanta Workers' Compensation law firm, will offer you a consultation to discuss your situation. We will then be able to gather important details, help assess your claim, and pursue benefits on your behalf.
